These Terms of Service ("Terms") govern your use of the LoanMe mobile application, website, and related services (collectively, the "Service") operated by LoanMe ("we", "us", or "our"). By accessing or using the Service, you agree to these Terms.
1. The Service
LoanMe helps individuals track informal personal loans between people they know. LoanMe is a record-keeping and coordination tool. We are not a bank, lender, broker, debt collector, or financial advisor. We do not move money, underwrite loans, or guarantee repayment.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract. You are responsible for ensuring your use of the Service complies with applicable laws.
3. Your account
You are responsible for safeguarding your sign-in credentials and for activity under your account. Notify us promptly at [email protected] if you suspect unauthorized access.
4. User content and loan records
You retain ownership of information you submit. You grant us a limited license to host, process, and display that information solely to operate the Service for you and your invited counterparties. You represent that you have the right to share any information you enter, including details about other people you invite.
5. Acceptable use
You agree not to:
- Use the Service for unlawful, fraudulent, or harassing purposes
- Attempt to access another user's account or data without authorization
- Interfere with or disrupt the Service or its security
- Reverse engineer or scrape the Service except as permitted by law
6. No professional advice
Loan terms, tax treatment, interest legality, and collection practices vary by location. Consult qualified professionals before entering financial arrangements. LoanMe does not provide legal, tax, or investment advice.
7. Third-party services
Authentication and infrastructure may be provided by third parties (such as Clerk and Railway). Your use of those features may also be subject to their terms and policies.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT LOAN RECORDS WILL BE ACCURATE OR COMPLETE.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR ANY LOAN ARRANGEMENT YOU ENTER OUTSIDE THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF USD $50 OR THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM.
10. Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if we discontinue the Service. Provisions that by nature should survive termination will survive.
11. Changes
We may modify these Terms or the Service. Material changes will be posted on this page with an updated effective date. Continued use after changes constitutes acceptance.
12. Governing law
These Terms are governed by the laws of the United States and the State of Texas, without regard to conflict-of-law rules, except where mandatory consumer protections apply in your jurisdiction.
